Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services operated by Circle Sure Technologies (Pty) Ltd, including the ERUS Consumer App and ERUS Work App (collectively, the "Services").

By creating an account, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

 

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use the Services. By using the Services, you represent and warrant that you meet these requirements.

 

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

You agree to provide accurate, complete, and current information during registration and to keep it updated.

We may suspend or terminate accounts that provide false information, misuse the platform, or violate these Terms.

 

3. Services Overview

The ERUS Apps connect consumers ("Clients") with independent service providers ("Professionals") for various personal, home, and business services.

Circle Sure Technologies acts as a technology platform, not as an employer or contractor of Professionals.

Clients

can request, schedule, and pay for services offered by Professionals.

Professionals

can advertise skills, receive bookings, and deliver services directly to Clients.

Circle Sure Technologies does not supervise, control, or guarantee the work of any Professional.

 

4. Payments and Fees

Payments are processed through secure third-party payment systems.

Pricing for each service is displayed before confirmation.

By confirming a booking, you authorize Circle Sure Technologies or its payment partners to process charges.

We may deduct platform service fees or commissions as disclosed to Professionals.

Refunds or adjustments are handled according to our Refund Policy.

 

5. User Responsibilities

You agree to:

  • Use the Services only for lawful purposes
  • Not engage in fraud, misrepresentation, or any misleading conduct
  • Not attempt to disrupt or reverse-engineer any part of the Service
  • Respect other users, service providers, and Company staff

Professionals must comply with all applicable labor, licensing, tax, and insurance obligations for their work.

 

6. Ratings and Reviews

Clients may rate or review Professionals after a service.

You agree that:

  • Reviews must be fair, factual, and free of abusive content
  • The Company may moderate or remove reviews that violate these rules
  • Ratings may affect your visibility within the ERUS platform

 

7. Communications

By using the Services, you consent to receive communications (via SMS, email, push notifications, or in-app chat) necessary for service fulfillment, security, or account management.

You can opt out of marketing messages at any time.

 

8. Intellectual Property

All trademarks, logos, software, text, and design elements in the Services are the property of Circle Sure Technologies or its licensors.

You may not copy, modify, or redistribute any part of the Service without written permission.

 

9. Termination

We may suspend or terminate access to the Services at any time, with or without notice, for:

  • Breach of these Terms
  • Fraudulent or unlawful activity
  • Prolonged inactivity or misuse of your account

Upon termination, all rights granted to you under these Terms cease immediately.

 

10. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available."

Circle Sure Technologies makes no warranties regarding the reliability, quality, or safety of services performed by independent Professionals.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages resulting from your use of the Services.

 

11. Indemnification

You agree to indemnify and hold harmless Circle Sure Technologies, its affiliates, and employees from any claim, liability, or expense arising from your:

  • Violation of these Terms
  • Misuse of the Services
  • Infringement of another party's rights
  •  

12. Modifications

We may update these Terms periodically. The latest version will always be available on our website and within our apps. Continued use after updates constitutes your acceptance of the revised Terms.

 

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of South African courts.
